We collect and process various personal data in and for our business. Here we inform you about this as required by the Swiss Data Protection Act.

3. WHAT PERSONAL DATA DO WE PROCESS?

We may process the following personal data about you:

• Technical data to operate and secure our website and generate usage statistics
• Master data such as your name and contact details and details of your relationship with us (e.g., customer, supplier)
• Contract data such as information about the type of contract
• Communication data, such as when you are in contact with us (e.g., by e-mail)
• Behavioral and preference data such as data about your behavior on our website to create usage statistics
• Other data such as data about your participation in events or campaigns or in connection with administrative or legal proceedings

4. WHY DO WE PROCESS PERSONAL DATA?

We do so for these purposes (in addition to those we disclose to you separately):

• Communicate with you
• Conclude/perform contracts with you, your employer and customers
• Run infrastructure, websites and apps
• Marketing (e.g., mailings with a link or unsubscribe option, events), CRM
• Market analysis, planning, development of products and services, R&D
• Compliance (adherence to laws, industry standards, directives, etc.) as well as legal proceedings and investigations
• Security safeguards, access control
• Company and risk management
• Corporate transactions (e.g., M&A)
• Other purposes such as media relations, shareholder services, investor relations, training, instruction, education, crime and fraud prevention.

5. TO WHOM DO WE DISCLOSE PERSONAL DATA?

We may disclose your personal data to third parties, in particular to the following categories of recipients:

• Service providers (who process personal data either for us, e.g., IT providers like Framer, or under their own responsibility, e.g., banks); Framer Privacy Statement
• Business partners such as suppliers, customers, marketing and project partners
• Authorities
• Other persons such as third parties in the context of agency relationships (e.g., your lawyer or your bank).

6. DOES YOUR PERSONAL DATA GO ABROAD?

Yes, your personal data may be processed in Switzerland, the EEA, the United States and exceptionally transferred to any country in the world. If it is a country without adequate data protection, we will enter into the EU Standard Contractual Clauses including the required Swiss Amendments or we may rely on consent or export data on a case-by-case basis, such as it may be necessary for the performance of a contract, it may concern personal data you have published or the transfer is necessary for legal proceedings abroad.

7. WHAT ARE YOUR RIGHTS?

You have certain rights in connection with our data processing, including, among other things, the right to access your data, the right to correct your data and a right to object.

8. WHAT ABOUT THE GDPR?

We do not assume that the EU General Data Protection Regulation (“GDPR”) applies in our case. However, should this exceptionally be the case for certain data processing activities, this Section 8 shall apply exclusively for the purposes of the GDPR and the data processing activities subject to it.

We base the processing of your personal data in particular on the fact that

• It is necessary for the initiation and conclusion of contracts and their administration and enforcement,
• It is necessary for safeguarding legitimate interests of us or of third parties as described in Section 4,
• It is legally required or permitted on the basis of our mandate or our position under the law of the EEA or a member state,
• You have separately consented to the processing,
• Or other legal bases as we may inform you about in each individual case.

We generally process your personal data for as long as our processing purposes (see Section 4), statutory retention periods, and our legitimate interests, require it or storage is technically necessary. If there are no legal or contractual obligations or technical reasons, we generally delete or anonymize your data after the storage or processing period has expired as part of our usual processes.

If you do not provide certain personal data, this may mean that the provision of the related services or the conclusion of a contract is not possible. We generally indicate where personal data requested by us is mandatory.

The right to object to the processing of your personal data as set out in Section 7 applies in particular to data processing for the purpose of direct marketing. You may contact us to get a full list of all the rights you have according to the GDPR.
